Judge Upholds Decision To Deny New Trial For Steven Avery …

Less than two months since they last faced each other in court, a Wisconsin judge has upheld her decision to deny Steven Avery a new trial for the 2005 murder of Teresa Halbach. Circuit Court Judge Angela Sutkiewicz had previously ruled on October 3 that “The defendant has failed to establish any grounds that would trigger the right to a new trial in the interests of justice.” Avery was the subject of the 2015 Netflix series “Making A Murderer,” which chronicled his troubled history with law enforcement, which includes a 1985 wrongful conviction on sexual assault charges for which he served 18 years in prison before being exonerated due to DNA evidence.

Avery turned down for new trial again

UNDATED (WSAU)  “Making A Murderer” defendant Steven Avery has been turned down for a new trial again.

A Sheboygan County judge denied Avery’s request from October to reconsider her order that denied a new trial in the 2005 murder of Teresa Halbach. Defense attorney Kathleen Zellner tweeted shortly after the ruling yesterday, however, that the appellate court has had jurisdiction in the case. She filed a Notice of Appeal on November 17th and it was acknowledged on Monday.

Avery and nephew Brendan Dassey were found guilty of the murder in 2007. The Netflix series “Making A Murderer” has put a spotlight on their case.

Avery and Dassey were both sentenced to life prison terms. Avery says he was framed, and his lawyers say there is new evidence and testimony that would exonerate him.

MANITOWOC, Wis. (AP) — A Wisconsin man convicted of first-degree intentional homicide in a case featured on the Netflix series “Making A Murderer” has once again been denied a new trial.

Steven Avery’s request was rejected Tuesday by Sheboygan County Circuit Judge Angela Sutkiewicz. Avery had asked the judge to reconsider her Oct. 3 decision rejecting his request for a new trial.

Avery and his nephew Brendan Dassey were sentenced to life in prison for the 2005 slaying of 25-year-old photographer Teresa Halbach. Avery insists police framed him.

Avery’s attorney says she had new testimony and evidence to present that warranted a new trial. But the judge said Tuesday that she finds no basis to reverse her earlier decision.

Avery is also seeking an appeal of the ruling with the Wisconsin Court of Appeals.

One of the star attorneys from Netflix’s hit series Making a Murderer has admitted he provided Steven Avery ineffective counsel during his 2007 murder trial as his appeal attorney Kathleen Zellner continues to point the finger at his nephew, Bobby Dassey, as a suspect.

Avery is serving a life sentence for the 2005 murder of photographer Teresa Halbach. He has always protested his innocence and believes he was framed. The Netflix documentary scrutinized inconsistencies in both the police investigation into the murder and Avery’s subsequent trial.

Avery’s lawyers in the initial trial, Jerry Buting and Dean Strang, gained global fame when Making a Murderer was released in December 2015, but have been accused by Avery in the past of mishandling his representation.
